If they took the deposit (your account should show the debit card transaction) then they accepted the risk initially and have subsequently acknowledged that you sent in the required additional documents (proof of bonus etc.) - therefore as you say the DD Mandate was in the same envelope it is most likely they mislaid the DD Mandate.
If they have never returned the deposit, or you have never banked any cheque from them it is obvious you never received the return. Furthermore they should have sent it or other letters cancelling the policy by Recorded Delivery and should have evidence of such a letter having been delivered and accepted - do they? If not they have made insufficient effort to make sure you know they are not accepting the risk. Go back to them and tell them you do not accept their decision and will if necessary appeal to the Financial Ombudsman Service. |

Gambit, i am with you and i agree 100% but it is not worth it now to claim maladministration. And probably they won't accept the claim. So better solution is to just take back the deposit and act like there was never any problem...!

If they don't have proof that they made contact with Cass over cancelling his policy, e.g. A signed delivery for cancellation of contact , a banked cheque of the returned deposit or a voice recording of them telling Cass his policy was cancelled(most unlikely). Then Cass still has a policy.
If they never returned the deposit then he certainly has a policy. The previous post was not made by me, but by an insurance expert. Bending over and taking it, is not the thing to do!!! |

This is it, he needs to go back there.
Cass, if you have a insurance certificate with a valid date on it, and they have no proof that you were aware that they canceled your policy. Then it ain't canceled and they are buggard!! If you fight this you should win. |
